Privacy Statement
In this privacy statement, the same definitions are used as in the General Terms and Conditions of Fjällvila Rooftop Tents B.V. h.o.d.n. fjallvila.co.uk and fjallvila.eu insofar as not otherwise provided herein.
- Offer: general term for, but not limited to, offer, quotation, order, quote, sales order and Agreement between User and Client.
- User: Fjällvila Rooftop tents B.V., h.o.d.n. RoovX, located at Spoorstraat 14G, 8271 RH, IJSSELMUIDEN, registered with the Chamber of Commerce with number 80319742.
- Client: Any (legal) person who places or has placed an order with the User.
- Agreement: the agreement established between User and Client through Offer and acceptance.
- Parties: User and Client jointly.
- Terms and Conditions: the general terms and conditions as used by FjällVila Rooftop Tents B.V., h.o.d.n. fjallvila.nl/fjallvila.eu.
If you are active on the Fjällvila Rooftop tents website (hereinafter referred to as “User”) or contact User, you may be sharing personal data with User. User handles this personal data with care and complies with the applicable laws and regulations herein. These laws and regulations concern the storage and use of your personal data.
This privacy statement explains what data is collected and what is done with the data. This privacy statement applies to all interaction between you and User, regardless of the form of communication. Your personal data will never be made available to third parties for commercial purposes.

What are personal data?
Any information that tells something about you and could potentially be used to identify you is personal data. Some examples are; a name, contact or address information and Citizen Service Number. Other data such as ethnicity, religion or a criminal record are special personal data.

No special personal data is collected and/or processed by User.
When are personal data processed?
- To be able to help if you have questions or complaints.
User is happy to help you if you run into something or if you have a question for User. You can call User, e-mail or fill out a contact form on the website. User may also obtain your information through third parties in connection with the provision of services. In order to further assist you, User processes some information from you. That way, User knows who you are and User can find you again at the next contact moment.
If you have questions or complaints for User, the following data will be stored:
- Name;
- Company name, if any;
- E-mail address;
- Phone number;
- Your message.
The legal basis for processing this personal data is: legitimate interest.
- To prepare and send an Offer to you.
Before User starts working for you, an Offer may be sent. In order to do so, User processes the following data:
- N/A data;
- E-mail address;
- Phone number;
- Company name, if any;
- Chamber of Commerce number, if any.
The legal basis for processing this personal data is: legitimate interest.
- To perform an Agreement or schedule a personal interview with you.
If you purchase services or goods from User, User wants to provide you with the best possible service. In order to properly execute the Agreement between the Parties, User processes the following data:
- N/A data;
- E-mail address;
- Phone number.
The legal basis for processing these personal data concerns: performance of the Agreement.
- To bill & collect.
The services purchased by you must be paid for. User will send you an invoice for that purpose. In connection with invoicing, the following data is processed by User:
- N/A data;
- E-mail address;
- Phone number;
- Company name, if any;
- Chamber of Commerce number, if any.
The legal basis for processing these personal data concerns: legal obligation.
- To send a newsletter.
If you would like to receive a newsletter from User, the following data will be stored for this purpose:
- N/A data;
- Company name, if any;
- E-mail address;
- Phone number.
The legal basis for processing this personal data concerns: consent and performance of the Agreement.
- To keep you informed of changes in services.
When changes are made to the service, Terms and Conditions, privacy statement or other important matters, User will be happy to notify you. For that reason, the following information will be processed by User:
- Name;
- Email address and confirmation message.
The legal basis for processing this personal data is: legitimate interest.
Cookies and similar techniques.
User uses functional, analytical and tracking cookies. A cookie is a small text file that is stored on your computer, tablet or phone when you first visit a website. User uses cookies with a purely technical functionality, so that the website works as intended. In this case, you do not need to re-enter your data for a new response. These cookies are automatically deleted again.
In addition, User uses analytical cookies such as Google Analytics to study visitor behavior in order to improve the website.
If you visit User’s website, cookies are stored temporarily to check if the browser accepts cookies. This cookie contains no personal data and is deleted as soon as the browser is closed. If you login to the web page, some cookies are stored in connection with login information and screen display options. Login cookies are valid for 2 days and cookies for screen display options are valid for 1 year. If you select the ‘remember me’ option, login information is stored for 2 weeks. At the time you log out, login cookies are deleted. The moment you edit a post or publish a post, an additional cookie is stored by the browser. This cookie contains no personal data and has only the post ID. This cookie expires after one day.
Transfer to partners.
User cooperates with various vendors and partners to perform the services.
These suppliers and partners include those who:
- Collecting Reviews: WebwinkelKeur and Google.
- Regular business e-mail traffic: Office 365
- Handle payments & collections: Mollie Payments
- The software: WooCommerce
- Web hosting provided: Whbsite
- Accounting services: Mollie and Snelstart
- Performs the Agreement or delivers goods.
User has entered into processor agreements with sub-processors to ensure the security of your data. User only cooperates with partners that can comply with the AVG legislation.
Transfer to third parties.
In principle, User does not share personal data with persons or organizations outside User, except with partners as described above. User may also be required to pass on data on the basis of a legal obligation.
Security of your data.
User has taken appropriate technical and organizational security measures to protect your personal data from misuse, unlawful or unauthorized use and loss.
All parties that process or can view your data for User (sub-processors) sign a processor agreement or confidentiality agreement.
Web store software – WooCommerce.
The web store of User is developed with software from WooCommerce. Personal data provided to User for the provision of services is shared with this party. WooCommerce has access to your data to provide User (technical) support. WooCommerce will never use your data for any other purpose. WooCommerce is required by the agreement we have with them to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. WooCommerce uses cookies to collect technical information regarding your use of the software, no personal data is collected and/or stored. WooCommerce reserves the right to share collected data within its own group to further improve its services.
Web hosting – Whbsite.
User’s web store was developed with WooCommerce software. User has chosen to place web hosting with Whbsite. Personal data that you make available to User for the purposes of our services are shared with Whbsite. Whbsite processes personal data on behalf of User and does not use your data for its own purposes. However, Whbsite may collect metadata about the use of the services. These are not personal data. Whbsite has access to your data to provide User with (technical) support, whereby your data will never be used for any other purpose. Whbsite is obliged by the agreement we have with them to take appropriate security measures. These security measures consist of the application of SSL encryption and a strong password policy. Regular backups are made to prevent loss of data.
Business email – Office 365.
For handling regular business e-mail traffic, the services of Office365 are used. This party has taken appropriate technical and organizational measures to prevent abuse, loss and corruption of your data and User’s data as much as possible. Office365 has no access to User’s inbox and all email traffic is kept confidential.
Payments – Mollie.
To handle (part of) the payments made in the web store of User, the platform of Mollie is used. Mollie processes your name, address and place of residence and your payment information such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve the service and, as part of this, share (anonymized) data with third parties. All of the above safeguards regarding the protection of your personal data also apply to those parts of Mollie’s services for which it engages third parties. Mollie will not retain your data longer than permitted under the statutory time limits.
Google-Analytics.
Through the website, cookies are placed by the American company Google, as part of the “Analytics” service. User uses this service to track and receive reports on how visitors use the website. This processor may be required by applicable laws and regulations to provide access to this data. User has not given Google permission to use the obtained analytics information for other Google services.
Microsoft.
User works with Microsoft Advertising to record how you use and interact with User’s website through behavioral statistics, heatmaps and session replay to improve and market User’s products/services. Website usage data is captured using third-party cookies and other tracking technologies to determine the popularity of products/services and online activities. In addition, Microsoft’s information is used for site optimization, fraud and security purposes. Posts on User’s website.
Posts on User’s website may contain embedded content (e.g., videos, images, messages, etc.). Embedded content from other sites behaves exactly as if the visitor had visited that other site.
Shipping and logistics.
If you place an order with User, it is User’s job to have this package delivered to you in a timely and careful manner. If a logistics service provider is used by User, User is required to share your personal data with this party.
Cooperation in fiscal and legal investigations.
In the event that User is required under a legal obligation to share your data in connection with government tax or criminal investigations, in such a case User will be forced to share your data, but will always first attempt to oppose this within the possibilities provided by law.
How long will your data be kept?
User uses your data exclusively for the purpose of providing services. That is, the purpose of processing is always directly related to the Assignment you provide. The data will not be used for (targeted) marketing purposes. If you share data with User and this data is used – other than at your request – explicit permission will always be requested.
User uses different retention periods for different data streams. You always have the right to request removal of personal data. See also the heading “Your rights” for this.
Pursuant to legal retention requirements, your data will be kept for a period of 7 years. This data retention time starts from the moment the assignment is completed for you. After the retention period of 7 years, your data will be deleted, unless otherwise stipulated by law.
An Offer and email messages are retained for the duration of 20 years. This is in connection with the service that User wishes to continue to provide to you. Your data will remain in the User’s system at least until that time.
Your rights.
You have the right to access, rectify, correct and delete your personal data. In addition, you have the right to withdraw your consent to data processing or object to the processing of your personal data by User.
You also have the right to data portability. You can send a request to inspect, correct, delete, data transfer of your personal data or a request to withdraw your consent or object to the processing of your personal data to info@fjallvila.nl.
User keeps a processing record of requests handled, for example in the case of a forgetting request, anonymized data is administered.
You have the right, where appropriate, to object to the processing of your personal data by or on behalf of User. If you object, data processing will be stopped immediately pending the handling of your objection. If your objection is well-founded, the User will make copies and/or copies of data that the User processes (or has processed) available to you and thereafter cease processing permanently. User does not process your data in such a way that this right is applicable. If you believe that it does, please contact our contact person for privacy matters.
To ensure that the request for inspection is made by you, User requests that you send a copy of your proof of identity with the request. In this copy, black out your passport photo, passport number and Citizen Service Number (BSN). This is to protect your privacy. If your request relates to a cookie, User asks that you also send this along. User will respond to your request as quickly as possible, but at the latest within four weeks. User would also like to point out that you have the possibility to file a complaint with the national supervisory authority, the Authority for Personal Data.
Reporting a data breach.
If, despite all precautions, a data leak occurs, User will comply with the data leak notification obligation and, if necessary, User will report this leak to the Personal Data Authority within 72 hours of discovery. Should you discover a data leak, User kindly requests you to share this as soon as possible but in any case within 24 hours after you have discovered the leak with User by sending an e-mail to info@fjallvila.nl. User can then take immediate action.
Liability.
User has no responsibility or liability for (the operation and/or content of) third party websites or services. Otherwise, the rules of the AVG and the Civil Code apply.
Changes to this statement.
User has the right to modify the content of this privacy statement at any time. This partly to respond to new developments in the field of legislation or regulations or changes within the company. If the new privacy statement has consequences for the way in which the data already collected are processed, you will be informed in a timely manner. User aims to publish the most recent version of the privacy statement on the website at all times.
